Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Chartex (“we,” “us,” or “our”), accessible at chartex.com. Chartex is operated by Chartex Software Labs - FZCO, a company registered in the IFZA Free Zone, Dubai Silicon Oasis, United Arab Emirates.

By accessing or using Chartex, you agree to these Terms. If you do not agree, please do not use the platform.

1. What Chartex Is

Chartex is a free music data analytics platform. We aggregate and process publicly available data from platforms including TikTok, Spotify, YouTube, Instagram, and Shazam to provide charts, trends, sound analytics, artist insights, and cross-platform intelligence.

Some features—such as personalized dashboards, email alerts, and saved preferences—require you to create an account. Our public charts and general analytics are accessible without an account.

2. Accounts

To access certain features, you may create an account using your email address. You agree to:

  • Provide accurate information
  • Keep your login credentials secure
  • Notify us promptly at [email protected] if you suspect unauthorized access

You are responsible for all activity under your account.

3. Pricing and Access

Chartex is currently provided free of charge. We reserve the right to introduce paid features, plans, or API pricing in the future. If we do, we will notify existing users in advance and clearly communicate any changes before they take effect. Access to previously free features will not be retroactively restricted without reasonable notice.

4. API Access

Chartex provides an API for programmatic access to our data. API access is subject to these Terms and falls into two categories:

Free use: The API is free for personal projects, internal tools, research, and experimental purposes — as long as the data is not resold, sublicensed, or presented to end users through a paid product or service.

Commercial use: If you use Chartex data in a paid product, service, or platform — including displaying, reselling, or redistributing it to paying customers — you are required to enter into a commercial agreement with us. Contact [email protected] to discuss commercial licensing.

We may introduce or adjust rate limits, authentication requirements, or pricing at any time with reasonable notice.

API users agree to:

  • Use the API in accordance with our documentation
  • Not exceed any published rate limits
  • Not redistribute raw API responses without a commercial agreement
  • Contact us before integrating Chartex data into any paid product or service

5. Intellectual Property and Data Ownership

Chartex does not claim ownership over the underlying raw data from third-party platforms (e.g., TikTok view counts, Spotify stream numbers). That data belongs to its respective sources.

However, the way we collect, aggregate, structure, analyze, and present this data—including our charts, rankings, analytics, dashboards, algorithms, and compiled datasets—constitutes our proprietary work and is protected as such.

You may not:

  • Systematically scrape, crawl, or extract data from the Chartex platform or API beyond normal use
  • Resell, redistribute, or sublicense Chartex data or analytics to third parties
  • Use Chartex data to build or operate a competing product or service
  • Remove or alter any proprietary notices or branding from our content

Individual, non-commercial use of data points (such as referencing a chart position in an article or social media post) is permitted with attribution to Chartex.

6. Acceptable Use

You agree not to:

  • Use automated tools, bots, or scripts to access the platform in a manner that exceeds reasonable use or degrades service for others
  • Attempt to gain unauthorized access to systems, accounts, or data
  • Circumvent any access controls, rate limits, or security measures
  • Upload malicious code or interfere with platform operations

Violations may result in temporary or permanent suspension of your access.

7. Data We Collect

Chartex collects minimal personal data:

  • Email address (when you create an account)
  • Usage analytics via Microsoft Clarity (session recordings, heatmaps, and anonymized interaction data)
  • Essential cookies required for platform functionality

8. Data Accuracy

Chartex aggregates data from third-party sources and presents it as-is after processing. While we strive for accuracy, we do not guarantee that all data is complete, current, or error-free. Platform APIs may change, data may be delayed, and third-party sources may contain inaccuracies.

You should not rely solely on Chartex data for business decisions without independent verification.

9. Third-Party Platforms

Chartex displays data sourced from third-party platforms including TikTok, Spotify, YouTube, Instagram, and Shazam. We are not affiliated with, endorsed by, or sponsored by any of these platforms. Their names and trademarks belong to their respective owners.

Changes to third-party APIs or policies may affect the availability or completeness of data on Chartex. We are not liable for such changes.

10. Suspension and Termination

We may suspend or terminate your access at our discretion if you violate these Terms, abuse the platform, or if required by law. Upon termination, your right to use the platform ceases immediately.

11. Disclaimer of Warranties

Chartex is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the platform will be uninterrupted, secure, or free of errors.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Chartex and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

13. Governing Law

These Terms are governed by and construed in accordance with the federal laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users by email at least 14 days before the changes take effect. Continued use of Chartex after changes become effective constitutes your acceptance of the revised Terms.
